APPLICABILITY
The following terms of service apply to DW Web Designs and DWWebDesigns.com.

ACCEPTANCE
Placing an order with DW Web Designs will be regarded as acceptance of these Terms and Conditions and agreement by you, hereafter known as the Client, to familiarize yourself with these terms and abide by them should you choose to use the services to which such terms apply. Orders may initially be placed by e-mail or phone, but must be confirmed in writing and will include a signed copy of these Terms and Conditions, as well as a $200.00 deposit.

REFUSAL OF SERVICE
We reserve the right to refuse, cancel, or suspend service at our sole discretion.

FEES
No additional charges outside the initial package agreement covered in the terms of service will apply, other than PayPal Transaction Fees, unless circumstances cause a need and will NOT be added without consent from the Client.

PAYPAL TRANSACTION FEES
Clients making deposits or payments via PayPal will incur an additional fee of 2.9% of their payment. This is a set Transaction Fee applied by PayPal to all payments received electronically by DWWebDesigns and it is the responsibility of the Client to pay this should they choose to make payments in this manner.

CONTENT
Web page design pricing assumes that all text is provided by the Client in electronic format (.txt, .doc, .wpd, and .rtf) on floppy, CD, e-mail, or retrievable ftp. Text on typed pages is acceptable but may be subject to a transfer fee of $5.00 per page of text.

All photos and other graphics are to be of high quality print suitable for scanning or electronically available (similar to text) in standard formats including .jpeg, .gif, .bmp, .tiff or Paint Shop Pro native format (PSP).

Pages containg over 1,000 words of text and more than 3 non-webready photographs will incur additional charges of $60 per hour billed in 15 minute hour increments to complete.

COPYRIGHT
Client will guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to DW Web Designs are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements.

ACCESSING FILES
DW Web Designs will require authorization to access files on storage servers. Access will be required to update, change, replace or otherwise modify existing web pages and will include ftp address, username and password information. Client will need to provide such information for work on all existing sites.

LINK AND PORTFOLIO
DW Web Designs will place a link from the Client's site to DWWebDesigns.com and list the client in the Portfolio of DW Web Designs. This can benefit the Client by drawing potential customers to the Client's site.

DOMAIN REGISTRATION AND SITE HOSTING
With the purchase of a Design Package for new sites, DW Web Designs will include 1 year of site hosting and 1 year of domain registration of an available .com, .net or .org name of the Client's choice through iPowerWeb.com or another web host selected by DW Web Designs. The domain name will be registered with the Client as owner and it will be the Client's responsibility to renew their hosting service and domain name at the end of said 1 year period should they wish to do so. DW Web Designs will be happy to assist the Client in renewing their domain name and hosting service for a fee of $50.00.

PRIVACY POLICY
DW Web Designs insures that all personal information being voluntarily submitted to us in the processing of your order (to be used for record and billing purposes, etc.), inclusive, but not limited to, credit card and other personal information, will be kept strictly confidential and used "solely" by DW Web Designs and its authorized representatives for the strict purpose for which it was intended, and for the benefit of the Client. We agree not to share, rent, sell or release this information to any individual, entity or third party, for any reason, without the specific written consent of the Client, with exception as required by Law, Regulation or Governmental Authority.
